1. Agreement
By using mgoa.dev and related services (the "Services"), you agree to these Terms and our Privacy Policy and Safety Notice. The Services are operated by [LEGAL ENTITY NAME] ("MGOA," "we"). If you disagree, do not use the Services.
2. Eligibility
You must be 18 or older.
3. The Services
The Services provide an assessment (the "Scorecard") and decision-training scenarios (the "Trainer"). They are educational only. Nothing in them is medical, safety, legal, or professional advice, and no result is a certification or guarantee of ability or safety. The Safety Notice is part of these Terms.
4. Acceptable use
You will not: scrape, copy, or republish the Services or their content; reverse engineer them; use them or their content to build or train a competing product or dataset; interfere with their operation; or use them unlawfully.
5. Intellectual property
The Services, scenarios, scoring, text, images, and design are owned by MGOA or its licensors. "MGOA," "Adventure OS," and "Adventure Ready Index" are our marks. We grant you a limited, revocable, non-transferable license to use the Services for personal, non-commercial use.
6. Your data
Our Privacy Policy explains how we handle personal information. You grant us a license to use de-identified and aggregated results to operate and improve the Services.
7. Third-party links
We are not responsible for third-party sites or services.
8. Disclaimer
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT ANY CONTENT IS COMPLETE, CURRENT, OR SUITABLE FOR YOUR CIRCUMSTANCES.
9. Outdoor activity risk
Outdoor activities are inherently dangerous and are undertaken independently of the Services. To the fullest extent permitted by law, you assume all risks of your activities and release MGOA, its owners, officers, employees, and contractors from claims arising from them.
10. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, MGOA WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF AMOUNTS YOU PAID US IN THE PRIOR 12 MONTHS OR US$100. Nothing in these Terms limits liability that cannot be limited by law, including for gross negligence or willful misconduct.
11. Indemnity
You will defend and indemnify MGOA against third-party claims arising from your misuse of the Services or violation of these Terms, to the extent permitted by law.
12. Team licenses
Organizational licenses, custom scenarios, and team dashboards are governed by a separate signed agreement. If it conflicts with these Terms, it controls.
13. Termination and changes
We may suspend or end access at any time. We may update these Terms by posting a new date; continued use means acceptance.
14. Governing law and venue
Minnesota law governs, without regard to conflict-of-law rules. Disputes will be brought exclusively in the state or federal courts located in Hennepin County, Minnesota, and you consent to their jurisdiction.
15. General
If a provision is unenforceable, the rest remains in effect. These Terms are the entire agreement on this subject. You may not assign them; we may.
